Wafapoints Terms and Conditions for Cardholders
Use of the Wafapoints Card is governed by the following terms and conditions. By signing an application, activating or using the Card the Cardholder is bound by them.
It is important that you read these terms and conditions.
1.Definitions:
In this Agreement the following words shall, unless the context otherwise requires, have the following meanings:
“Agreement”: The contract between the Cardholder and the Bank , including it’s assigns, constituted by these terms and conditions.
“Authorised Agent”: Any person or persons properly appointed by the Bank for the purpose of supporting Wafapoints.
“Bank”: The Commercial bank of Qatar QSC or its legal assigns who own the registered brand name of Wafapoints.
“Bonus Percentage”: The percentage of the total value of a purchase transaction given by the Rewards Partner to the Cardholder(s) Wafapoints Card, in the form of Points.
“Bonus Point Exchange Rate”: The exchange rate of one Wafapoint being the equivalent of 10 Qatari Dirhams or the equivalent in any other currency.
“Card”: The Wafapoints Card issued by the Bank and used for the rewards programme which the terms and conditions of this Agreement govern.
“Cardholder”: An individual to whom a Wafapoints Card is issued to be used in accordance with the terms of this Agreement.
“Loyalty Transaction”: A transaction at a Rewards Partner outlet that results in Points being awarded to the Cardholder.
“PIN”: The personal identification number issued to a Cardholder, or selected by a Cardholder and used to identify and authenticate the Cardholder as a participant in the Wafapoints programme.
“Points”: Wafapoints.
“Redemption Transaction”: A purchase or distribution of goods and services by a Rewards Partner whereby a Wafapoints Cardholder redeems accumulated Wafapoints in either full or part payment.
“Rewards Partner”: A merchant outlet, retailer or service provider who enters into an agreement with the Bank to participate in the Wafapoints rewards programme through the award and/or redemption of Points.
"Wafapoints": Wafapoints reward Points issued by the Bank and awarded or redeemed by Wafapoints Rewards Partners.
The following headings used in the Agreement are for convenience only and shall not affect the interpretation of any provision of this Agreement.
2. The Card
2.1 The Card is at all times the property of the Bank. The Card must be surrendered to the Bank immediately upon request by them or by their Authorised Agent.
2.2 The Cardholder may collect the Card from the Bank or a place designated. For the Banks credit and charge cardholders the Card will be delivered by post to the address notified to the Bank.
Care of the card:
2.3 Upon receipt of the Card, the Cardholder must immediately change the initial PIN provided with the Card to a personal PIN of their choice and activate the Card. This must be done at any Rewards Partner outlet or at any other location advised by the Bank. No Loyalty Transaction will be necessary to activate the Card.
2.4 The Card is not transferable and the Cardholder is the sole authorised user of the Card. The Cardholder should under no circumstances whatsoever allow the Card and/or PIN to be used by any other individual.
2.5 The Cardholder must keep the Card in a safe place at all times and keep the PIN secret.
2.6 In the event that the Cardholder loses or damages the Card the Bank at its discretion may issue such substitutes and shall be entitled at its sole discretion to charge the Cardholder a fee for the provision of such Cards.
Use of the Card
2.7 Card may only be used for Loyalty Transactions or Redemption Transactions at Rewards Partner outlets until the expiry of the Points or the Card.
- The Card and PIN must not be used contrary to these terms and conditions contained and must not be used in any way that would result in credit of Points on the Card or redemption of Points on the Card other than for a qualifying purchase.
2.9 The Bank and its Rewards Partners reserve the right to not redeem or allow the redemption of any Points which have been acquired contrary to these terms and conditions or in breach of any other guidelines stipulated by the Bank from time to time.
2.10 The Cardholder agrees to comply with any reasonable instructions that The Bank may give concerning the use and safekeeping of the Card.
3. Collecting Points
3.1 A Loyalty Transaction occurs when the Cardholder presents the Card at the time and point of sale at a Rewards Partner outlet.
3.2 The Cardholder must not attempt to enter a Loyalty Transaction unless they purchase qualifying goods or services.
3.3 When the Cardholder presents the Card at a Rewards Partner outlet and a purchase is made, the Cardholder receives a credit in the form of Wafapoints.
3.4 When the Cardholder presents the Card at a Rewards Partner outlet in the circumstances described above, the Rewards Partner is required to take all necessary steps to:
3.4.1 Apply the agreed Points to the total Qatari Riyal value of the purchase value.
3.4.2 Convert such sum into Wafapoints by referring to the Bonus Point Exchange Rate.
3.4.3 Credit the Card with the resulting number of Wafapoints.
- The Bank will record the relevant transactions and reward the Cardholder with Wafapoints. These Points will be collected and recorded onto a statement, which will be sent to the Cardholder at the Banks discretion at intervals by post or e-mail.
4. Redeeming Points
4.1 A Redemption Transaction occurs when the Cardholder presents the Card at the time and point of sale at a Rewards Partner outlet and purchases goods and services by way of redeeming Points previously accumulated on the Card.
4.2 When the Cardholder presents the Card at the Rewards Partner outlet in the circumstances described above the Rewards Partner is required to take all the necessary steps to:
4.2.1 Calculate the number of Points equivalent to the total Qatari Riyal value of the Redemption Transaction.
4.2.2 Accept the resulting number of Points as full consideration for the goods and services forming the subject matter of the sale value.
5. Expiry of Points
5.1 Accumulated points are valid for two years from the date that they are earned and applied to the Cardholder Card. Points will automatically purge from the Cardholder Card on this expiry date.
5.2 The Bank may, at its absolute discretion, extend the validity of Points to uses of its banking or investment products and services.
6. Refunds
6.1 Should a Rewards Partner credit the Cardholder with a refund for goods or services purchased in association with a Loyalty Transaction, the Cardholder must present the Card and the Wafapoints receipt to the Rewards Partner at the time that the refund is made in order that the appropriate number of Wafapoints can be deducted from the Card.
6.2 In the event that there are insufficient Wafapoints on the card the Rewards Partner will retain from the cash refund the sum of QR 0.1 for each and every Wafapoint that cannot be deducted from the Card.
6.3 In the event that the refund is made other than by cash the Cardholder must pay the Rewards Partner QR 0.1 for each and every point that cannot be deducted from the Card.
7. Renewal, Replacement and Withdrawal
7.1 The Bank reserves the right at all times to decide whether or not to issue, renew or replace Cards to Cardholders.
7.2 The Bank can, at its absolute discretion, cancel the Cardholder Card at any time and prevent further Loyalty Transactions or Redemption Transactions from taking place. In this event the Cardholder has no right of recourse against the Bank or any other party for any loss, damages, claims or suit howsoever arising and neither the Bank nor the Rewards Partner(s) shall be liable in any way to the Cardholder. The Cardholder will not, from the date of such cancellation, be entitled to redeem any reward Points at any Rewards Partner outlet nor will the Cardholder be entitled to obtain the value of such reward Points from the Bank.
8. Personal Information
8.1 To help prevent and detect Card misuse, fraud or other crimes, personal information may be held and processed by computer or otherwise by the Bank and may be disclosed and shared with the Rewards Partner(s). Demographic and generic information provided by the Cardholder may be held and used by the Bank for whatever reason.
8.2 In order to optimise the benefits of the Cardholder membership of Wafapoints the Cardholder must notify the Bank as soon as possible if there is any change in the Cardholder name or address or any other personal details.
9. Exclusion of Liability
9.1 Commercialbank shall be under no liability whatsoever to the Cardholder in respect of any loss or damage arising directly or indirectly out of:
9.1.1 The Bank or any Rewards Partner refusing to allow a Loyalty Transaction or Redemption Transaction or refusing to accept the Card or the PIN.
9.1.2 The refusal of any Rewards Partner to honour or accept the Card or for any defect or deficiency in the goods or services supplied to the Cardholder by any Rewards Partner, or, where applicable, for any breach or non-performance by any Rewards Partner of a purchase transaction associated with a Loyalty Transaction or a Redemption Transaction.
9.1.3 Loss arising from the malfunction of any terminal or system at any Rewards Partner outlet or disruption of communication systems.
9.1.4 The exercise by the Bank of its rights to demand and procure surrender of the Card prior to the expiry date whether such demand and surrender is made and/or procured by the Bank or any other party.
9.1.5 The exercise by the Bank of its rights to terminate any Card.
9.1.6 Any dispute between the Cardholder and any Rewards Partner or any other person.
9.2 The Bank accepts no responsibility or liability whatsoever for any direct, indirect or consequential loss, damage, costs or otherwise arising from the use of the Card or from participation in the Wafapoints programme. If the Bank, an Authorised Agent or a Rewards Partner is found liable for any such item by operation of law or otherwise, liability shall be limited to the value of any Points lost, determined at an exchange rate of one (1) Point being equivalent to ten (10) Qatari Dirhams (QR 0.1).
10. Indemnity
10.1 The Cardholder undertakes and agrees to indemnify the Bank and keep the Bank indemnified from and against any loss, damage, liability, costs and expenses whether legal or otherwise which the Bank may incur by reason of these terms and conditions or any breach of the Banks rights as herein provided. All costs and expenses in such regard shall be payable by the Cardholder.
11. Validity of Terms and Conditions
11.1 The Bank may vary these terms and conditions, including fees and charges, at any time or times whether or not a similar variation is made to these terms and conditions with any other Cardholder. Without giving any prior notice the Bank may alter or amend these terms and conditions at its absolute discretion and with immediate effect.
11.2 The Cardholder shall not assign his/her benefits or obligations under these terms and conditions to any other party.
11.3 These terms and conditions apply to all territories wherever Wafapoints Loyalty Transactions and Redemption Transactions take place, either within the State of Qatar or overseas through the Banks international partners.
11.4 The Bank shall be entitled at any time to assign the whole or any part of its rights or obligations under this Agreement without notice to the Cardholder.
11.5 In the event that the Cardholder does not wish to be bound by these terms and conditions the Cardholder must cut the Card in half and return both halves to the Bank.
12. General
12.1 Wafapoints cannot be transferred from one Card to another Card without the express written consent of the Bank.
12.2 All Card and PINs, notices of termination or any other communication under these terms and conditions may be delivered personally or sent by ordinary post to the Cardholder’s current declared address. Such communications shall be deemed to have been served on the Cardholder on the day of delivery if delivered by hand, and on the next day after posting if sent by post.
12.3 Each of these terms and conditions shall be severable and distinct from one another and if at any time any one or more of such terms and conditions is or becomes invalid, illegal or unenforceable, the validity, legality or the enforceability of the remaining provisions shall not in any way be affected or impaired thereby.
12.4 The Bank does not give any warranty or guarantee in respect of the delivery, quality, design and specifications of any goods or services purchased by the Cardholder at any Rewards Partner, whether by redeeming Wafapoints or by payment in any other form.
12.5 The terms and conditions are governed by and shall be construed in accordance with the laws of the State of Qatar. The Cardholder hereby submits irrevocably to the non-exclusive jurisdiction of the civil courts of the State of Qatar.
12.6 In the event of a dispute between the Cardholder and a Rewards Partner, which requires arbitration by the Bank the decision by the Bank will be final and binding upon all parties.
13. Execution
13.1 This Agreement shall be executed in English and Arabic. In the event of a dispute between the English and Arabic, the Arabic version shall prevail.
14. Entire Agreement:
14.1 This Agreement constitutes the entire Agreement between the parties and both parties acknowledge that they have not entered into this Agreement in reliance wholly or partly on any statement or representation made to any of them by the other, by any Rewards Partner or by any other third party, except as contained or referred to herein.
